Terms of Service

Please review the following terms and conditions that govern your use of our website and participation in our martial arts programs.

Acceptance of Terms

By accessing or using the website located at www.ohanamartialartsacademy.com (the "Site") and by enrolling in or participating in any programs or services offered by Ohana Martial Arts Academy ("we," "us," or "our"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you may not use our Site or participate in our programs.

If you are enrolling a minor (under 18 years of age), you represent that you are the parent or legal guardian of that minor and that you accept these Terms on their behalf.

Description of Services

Ohana Martial Arts Academy provides martial arts instruction in International Kenpo Karate Jiujitsu and Kamishin Ryu Jujitsu at our facility located at 8196 Colorado Blvd, Firestone, CO 80520. Our services include:

  • Tigers Program (Ages 5-8): Foundational Kenpo basics, coordination, and anti-bullying education
  • Youth Program (Ages 8-12): Beginner and advanced Kenpo with Jiujitsu introduction
  • Teens Program (Ages 12-18): Advanced techniques, leadership development, and stress management
  • Adults Program (Ages 18+): Self-defense, conditioning, and mental focus training
  • Kamishin Ryu Jiujitsu (Ages 12+): Specialized training sessions

We reserve the right to modify, suspend, or discontinue any aspect of our programs or services at any time, with reasonable notice to enrolled members when possible.

Membership Terms

Ohana Martial Arts Academy operates on a month-to-month membership basis. We do not require long-term contracts. Key membership terms include:

  • Memberships are billed on a monthly recurring basis on the date of your initial enrollment
  • All memberships include unlimited class attendance within your enrolled program
  • Family discounts and special pricing for teachers and first responders may be available; please inquire for current rates
  • Our rotating curriculum allows students to join at any time without feeling behind
  • Membership fees are non-refundable for the current billing period once charged

Free Trial Classes

We offer free trial classes for prospective students. Trial class participants must have a completed registration form signed by a parent or guardian (for minors) before participating. Participation in a trial class does not obligate you to enroll in a membership. Trial class availability and terms are subject to change at our discretion.

Cancellation Policy

Because we operate on a month-to-month basis, you may cancel your membership at any time. To cancel, you must:

  • Provide written notice of cancellation at least 30 days prior to your next billing date
  • Submit cancellation requests via email to info@ohanamartialartsacademy.com or in person at our academy

Upon cancellation, your membership will remain active through the end of your current paid billing period. No partial refunds will be issued for unused portions of the current billing cycle.

Assumption of Risk and Liability Waiver

Martial arts training involves inherent risks of physical injury. By enrolling in our programs (either for yourself or for your minor child), you acknowledge and agree to the following:

  • You understand that participation in martial arts classes, including Kenpo Karate and Jiujitsu, involves physical contact and carries a risk of injury, including but not limited to bruises, sprains, fractures, and other bodily harm
  • You voluntarily assume all risks associated with participation in our programs
  • You agree to release, waive, discharge, and hold harmless Ohana Martial Arts Academy, its owners, instructors, employees, and agents from any and all liability, claims, demands, or causes of action arising out of or related to any injury sustained during participation in our programs, except in cases of gross negligence or willful misconduct
  • You confirm that the participant (yourself or your child) is in adequate physical health to participate in martial arts training, and you have disclosed any relevant medical conditions to our instructors
  • You agree to follow all safety rules, instructions, and guidelines provided by our instructors at all times

A separate written waiver and release form may be required before participation in classes. This section does not replace that document but supplements it.

Code of Conduct

All students, parents, and visitors are expected to uphold the values of Ohana Martial Arts Academy. Our code of conduct includes:

  • Respect: Treat all instructors, fellow students, staff, and visitors with courtesy and respect
  • Safety: Follow all safety rules and instructor guidance; never use martial arts techniques outside of class in an aggressive or inappropriate manner
  • Inclusivity: We are an LGBTQ+ friendly and transgender safe space; discriminatory behavior of any kind will not be tolerated
  • Punctuality: Arrive on time for classes and notify instructors of any expected absences when possible
  • Hygiene: Maintain proper personal hygiene and wear clean, appropriate training attire
  • Sportsmanship: Demonstrate good sportsmanship and support fellow students in their training

We reserve the right to suspend or terminate the membership of any student who violates our code of conduct, engages in disruptive behavior, or poses a safety risk to others. In such cases, any remaining prepaid membership fees may be refunded on a prorated basis at our sole discretion.

Intellectual Property

All content on this Site, including but not limited to text, graphics, photographs, logos, icons, images, audio clips, video clips, and software, is the property of Ohana Martial Arts Academy or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content from our Site without our prior written consent, except as follows:

  • You may temporarily store copies of materials in RAM incidental to your accessing and viewing those materials
  • You may store files that are automatically cached by your web browser for display enhancement purposes
  • You may print or download one copy of a reasonable number of pages from the Site for your own personal, non-commercial use

The Ohana Martial Arts Academy name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Ohana Martial Arts Academy. You may not use such marks without our prior written permission.

Photography and Media Release

Ohana Martial Arts Academy may photograph or record video during classes, events, and promotions. By enrolling in our programs, you grant us permission to use photographs and video recordings of the participant for promotional purposes, including but not limited to our website, social media channels, and marketing materials, unless you opt out in writing.

If you do not wish for yourself or your child to be photographed or recorded, please notify us in writing at info@ohanamartialartsacademy.com and we will make reasonable efforts to honor your request.

Website Use

You agree not to use our Site in any way that:

  • Violates any applicable federal, state, local, or international law or regulation
  • Involves the transmission of any advertising or promotional material without our prior written consent, including "spam" or similar solicitations
  • Impersonates or attempts to impersonate Ohana Martial Arts Academy, an employee, another user, or any other person or entity
  • Introduces any viruses, malware, or other harmful material to our Site
  • Attempts to gain unauthorized access to any portion of the Site, its servers, or any connected systems

Disclaimer of Warranties

Our Site and its contents are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

While we strive to provide accurate information about our programs and services, we make no guarantees regarding specific outcomes from participation in our martial arts classes, including fitness improvements, belt promotions, or self-defense proficiency.

Limitation of Liability

To the fullest extent permitted by applicable law, Ohana Martial Arts Academy, its owners, instructors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or participation in our programs, whether based on warranty, contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold harmless Ohana Martial Arts Academy, its owners, instructors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our Site or services.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or your use of our Site or services shall be brought exclusively in the state or federal courts located in Weld County, Colorado, and you consent to the personal jurisdiction of such courts.

Changes to These Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when posted to the Site and apply to all access to and use of the Site thereafter. When we make material changes, we will update the "Last Updated" date at the top of this page.

Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to review this page periodically so you are aware of any updates, as they are binding on you.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
